The US Government May Soon Be Able to Shut Down Your Vehicle

Representative Thomas Massie’s attempt to defund a federal “kill-switch” mandate, embedded in President Joe Biden’s $1 trillion 2021 infrastructure law, recently failed on the House floor.

The amendment sought to remove a controversial provision that requires all vehicles manufactured post-2026 to incorporate technology capable of immediately disabling them “if impairment is detected.” It faced a vote of 229 to 201, with some Republicans like Reps. Kevin Kiley (CA) and Nancy Mace (SC), voting against, and two Democrats, Reps. Alexandria Ocasio-Cortez (NY) and Marie Gluesenkamp Perez (WA), voting for.

Massie, a Kentucky Republican, argued against what he deemed a federal overreach, envisioning a scenario where the government becomes the “judge, jury, and executioner” of the fundamental right to travel freely.

Despite claims on the House floor that the bill doesn’t mandate “kill switches” or monitor driving behavior, Massie argues that the legislation explicitly outlines a system designed to “monitor the performance of a driver” and “prevent or limit motor vehicle operation.” 

Supporters of the “kill switch” argue its potential to reduce drunk driving. However, Massie portrays the legislation as something reminiscent of science fiction, echoing fears of a society preoccupied with crime prevention from novels like Philip K. Dick’s “The Minority Report,” which raises questions about the balance between safety and civil liberties.

The debate over the mandate’s implications and the societal cost of drinking and driving, which claims over 10,000 American lives annually, underscores the need for a thorough public discussion. Critics highlight the quiet inclusion of this mandate within a massive spending bill, potentially benefiting specific companies. 

With the implementation slated for 2026, Massie aims to rally support for his cause, emphasizing the importance of upholding constitutional principles and privacy rights in the face of emerging technology.
