Google Employee Stole Trade Secrets From Google For China

The United States District Court for the Northern District of California has indicted Linwei Ding, also known as Leon Ding, on charges related to the theft of trade secrets. The charges include multiple violations under Title 18 of the United States Code.

Ding’s alleged actions, according to the indictment, involve the misappropriation of proprietary information from Google. The indictment provides detailed allegations concerning Ding’s employment at the firm as a software engineer, where he purportedly gained access to sensitive trade secrets related to hardware infrastructure, software platforms, and AI models.

Despite Google’s stringent proprietary information protection policies, Ding is accused of systematically exfiltrating more than 500 unique files containing confidential information between May 2022 and May 2023.

Furthermore, the indictment alleges that Ding failed to disclose his affiliations with PRC-based companies in the AI industry, including Rongshu and Shanghai Zhisuan Technology Co. It asserts that Ding traveled to the People’s Republic of China (PRC) and engaged in activities aimed at raising capital for these companies, all while clandestinely continuing to exfiltrate confidential data from Google.

Ding’s actions came to light when Google detected unauthorized uploads from Ding’s account in December 2023. Despite signing a “Self-Deletion Affidavit” in an attempt to cover his tracks, Ding’s subsequent resignation from Google and his booking of a one-way ticket to Beijing raised further suspicions, leading to an FBI probe.

The Federal Bureau of Investigation executed search warrants on Ding’s accounts, uncovering substantial evidence linking him to the alleged theft of trade secrets. The indictment outlines Ding’s unauthorized access to and dissemination of confidential information crucial to Google’s operations, particularly concerning chip architecture, software design specifications, and system management protocols.

The indictment concludes with forfeiture allegations, asserting that Ding stands to forfeit any property or proceeds derived from his alleged criminal activities, as prescribed by federal law.

As of now, Linwei Ding faces multiple counts of theft of trade secrets, which carry significant legal ramifications upon conviction. The allegations state that Ding, with intent to convert trade secrets related to products and services used in interstate and foreign commerce for the economic benefit of others, knowingly engaged in various actions, including stealing, copying, and possessing trade secrets belonging to Google. The items involved in each count include chip architecture and software design specifications for TPU versions 4 and 6, hardware, software, and system management specifications for GPU chips deployed in data centers, and software design specifications for Google CMS managing machine learning workloads.
