Federal Court Challenges Against Ksi Lisims LNG Withdrawn After Benefit Deals Struck

Western LNG has signed benefit agreements with three First Nations in northern British Columbia, clearing two active Federal Court challenges against the $10 billion Ksi Lisims LNG project planned for Pearse Island.

The Metlakatla First Nation and the Lax Kw’alaams Band had each filed separate judicial review applications in Federal Court in fall 2025, alleging Ottawa ignored their concerns about the project’s adverse impacts. Both have now withdrawn those challenges. The Gitxaala Nation also signed a benefit agreement, though it had not filed a legal challenge.

The Lax Kw’alaams Band’s deal includes procurement opportunities. The Metlakatla First Nation’s, as well as the Gitxaala Nation’s, deal covers climate initiatives and business opportunities.

“This agreement reflects the importance of working together to create opportunities that benefit both our members and the broader northwest region,” said Robert Nelson, Chief Councillor of the Metlakatla First Nation.

Western LNG head Davis Thames called the agreements a core priority. “Continuing to advance these foundational agreements with Indigenous Nations helps to build prosperity for communities in northwest B.C. and continues to be a key priority for Ksi Lisims LNG and PRGT,” he said.

All three nations also updated or signed new agreements covering the Prince Rupert Gas Transmission pipeline, which would carry Montney gas from northeastern B.C. to the Pearse Island terminal for liquefaction and export.

Ksi Lisims is being developed by Western LNG, Rockies LNG, and the Nisga’a Nation, on whose traditional territory the floating terminal would sit. Federal Natural Resources Minister Tim Hodgson cited the agreements at the Global Energy Show in Calgary, saying they show that when government, proponents, and Indigenous communities engage in good faith, they can “find solutions that benefit everyone.”

B.C. issued an environmental assessment certificate for the project on September 16, 2025. The project partners are targeting a final investment decision in 2026.
