Elections Alberta Targets Alberta Prosperity Project in Financial Showdown

Elections Alberta has requested a court injunction to compel the Alberta Prosperity Project, a prominent independence advocacy group, to disclose its financial records and donor list, alleging the organization breached third-party advertising laws by exceeding the province’s $1,000 spending limit for non-registered groups.

The agency’s investigation, launched in early January, claims Alberta Prosperity Project funded public messaging, including a tractor-trailer advertisement off Highway 2 south of Edmonton reading “Say Yes to an independent Alberta.” The ad, seen by over 30,000 vehicles daily, costs approximately $700 monthly, potentially pushing Alberta Prosperity Project over the legal threshold since the independence signature campaign began on January 2. Additional evidence cited by Ryan Tebb, Elections Alberta’s director of compliance and enforcement, includes social media posts and town hall events during the campaign’s first week.

Alberta Prosperity Project’s legal counsel and independence movement leader, Jeffrey Rath, has resisted the probe, arguing the group’s current hiatus disqualifies it from registering as a third-party advertiser. On Monday, Rath dismissed the investigation as a “waste of time” after a brief court appearance where Elections Alberta sought to adjourn the hearing without a future date set.

“They haven’t got a case and it’s extremely unlikely that they’re going to be moving forward,” Rath stated after presenting documents to the agency last Friday.

The scrutiny comes amid heightened attention on Alberta Prosperity Project’s ties to external actors. Over the past year, Rath and Alberta Prosperity Project CEO Mitch Sylvestre have met with U.S. State Department officials at least three times, raising questions about potential foreign interest in Alberta’s independence push, especially given U.S. President Donald Trump’s provocations about Alberta and Canada as a “51st state.”

Financial transparency remains elusive. Corporate records show the Alberta Prosperity Society, which governs Alberta Prosperity Project, received over $1 million in donations in 2022 and $103,000 in 2023, though later figures are unavailable.

Meanwhile, Rath and Sylvestre have shifted focus to a new group, Stay Free Alberta, to gather the 178,000 signatures needed for an independence referendum, potentially slated for October 19 if legal challenges fail. Rath claims Stay Free Alberta reimbursed Alberta Prosperity Project for past advertising expenses, including the Highway 2 trailer ad.

Elections Alberta has faced pushback from Alberta Prosperity Project since February, missing multiple deadlines to provide financial data. A stern letter from Election Commissioner Paula Hale on February 25 criticized Rath’s responses as “at best, misinformed; at worst, obstructive.”

The case continues to unfold against a backdrop of growing support for independence, with polls showing 20 to 30 percent of Albertans in favor, fueled by Premier Danielle Smith’s direct-democracy reforms and federal political tensions.

If unresolved, the legal battle could delay or derail the referendum signature drive, with Stay Free Alberta now at the forefront of the effort to secure a vote by mid-October.
