The Trump administration’s new supersonic flight push could hand its biggest near-term win not to passengers, but to companies trying to raise money, certify aircraft, and convince airlines that high-speed jets can finally fly domestic routes without breaking noise rules.
The Federal Aviation Administration has proposed replacing the US ban on most civil supersonic flight over land with a noise-based approval system. The draft rule, titled “Enabling Supersonic Overland Flight,” would repeal the longstanding prohibition on civil aircraft flying above Mach 1 over US land, provided operators prove that sonic boom overpressure at the surface does not exceed 0.11 pound per square foot.
Under current FAA guidance, civil aircraft are prohibited from exceeding Mach 1 over land unless they receive a special flight authorization, a process currently tied to testing and environmental review.
Transportation Secretary Sean Duffy pitched the proposal as the return of a “Golden Age of Travel,” while FAA Administrator Bryan Bedford said advances in aerospace engineering, materials science, noise reduction and operating concepts could “ultimately repeal the ban from the 1970s” while minimizing community noise impacts. The Department of Transportation said the FAA aims to finalize this rule and a separate landing-and-takeoff noise rule by mid-2027.

The proposed rule follows Trump’s June 6, 2025 executive order directing the FAA to repeal the overland supersonic ban and establish an interim noise-based certification standard. The order also directs US agencies to coordinate supersonic research and seek international alignment through aviation partners and the International Civil Aviation Organization.
The real beneficiary is regulatory certainty
The company most visibly positioned to benefit is Boom Supersonic, the Colorado startup developing the Overture passenger jet. Boom has marketed a “Boomless Cruise” approach based on Mach cutoff, where atmospheric conditions, speed and altitude are used to prevent a sonic boom from reaching the ground. The DOT’s own announcement describes Mach cutoff as a key technique for reducing ground-level impact.

Boom says its XB-1 demonstrator broke the sound barrier six times without an audible boom on the ground. That claim comes from Boom, not an independent FAA certification finding, but it matters because the FAA proposal is built around methods that operators can use to show compliance through measurement, modeling or other approved techniques.

The agency estimates the rule change would save industry about $1.57 million and the FAA about $852,135 in flight authorization processing over the analysis period, for total savings of roughly $2.42 million.
The larger value is strategic. A rule pathway can help manufacturers lock designs, attract capital, and tell airline customers that domestic supersonic routes are no longer legally dead on arrival.
Boom has orders and pre-orders from United Airlines, American Airlines, and Japan Airlines, according to the companies cited. American said in 2022 that Boom’s order book, including purchases and options from American, United, and Japan Airlines, stood at 130 aircraft.
Reuters reported that Boom’s XB-1 became the first privately funded aircraft to break the sound barrier in January 2025, reaching Mach 1.1 over the Mojave Desert. The same report said Boom planned to manufacture Overture jets in Greensboro, North Carolina, with a target capacity of 66 aircraft annually.
Who wins in the rule change?
Boom’s early investors included 8VC, according to Axios. 8VC was founded by Joe Lonsdale, the Palantir co-founder and venture capitalist. The Financial Times reported in 2024 that Lonsdale was among prominent tech figures backing America PAC, the pro-Trump super PAC associated with Elon Musk’s support for Trump’s presidential campaign.
Other potential winners include aerospace firms developing high-speed aircraft, future suppliers of engines, avionics and noise-modeling systems, and airlines with supersonic options. Lockheed Martin is relevant through NASA’s X-59 quiet supersonic program, though that is a government research aircraft rather than a commercial airliner. Hermeus also appears in FAA records as a company with a special flight authorization for supersonic testing.
For the industry, the old rule creates a chicken-and-egg problem. Manufacturers need domestic routes to support the economics of supersonic aircraft. Regulators need data showing those aircraft will not create unacceptable noise. The current special authorization system allows testing, but the FAA draft says it does not allow normal civil supersonic flight outside research and controlled testing purposes.
The proposed rule tries to solve that gap by allowing operators to seek a general FAA finding that their aircraft and operating method can keep sonic boom impacts under the 0.11 psf standard. Once that finding is valid, the operator would not need special approval for each individual flight or each specific operating area, as long as it follows FAA conditions and limitations.
The FAA is not pretending the costs are fully known. The draft says operators may need avionics or other technology to demonstrate that sonic boom overpressure will remain below the proposed threshold, but the agency says it cannot estimate those costs and is seeking public comment.
